Acceptable Use and Indemnification Policy

WREC reserves the right to change and update this Policy at any time. Please refer to the Policy regularly for information that may affect the terms of your Subscription.

WREC strives to provide the best possible service to all our members, but we will not tolerate any unlawful activity or abuse on our wireless Internet network. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you and other WREC members, and us, against such harm.

Email Policy:

WREC may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Your email account may not be referenced as originator, intermediary, or reply-to address of such email. We consider mass email as any email messages sent to more than 10,000 email addresses in one day or more than 10 news groups.

Free WREC E-mail accounts will be kept below 5 MB in total, unless previously arranged with WREC technical support. (Subscribers may purchase additional space in 5 MB increments.) If your email account becomes greater than 5 MB, WREC reserves the right to move the e-mail to another server and delete it after 30 days. The owner of the e-mail account will be contacted before we move the mail. If your mail has been moved please contact WREC Tech Support by calling WREC the Technical Support phone number 1-888-276-8092, or e-mailing to support@wrecwireless.coop with instructions to correct the situation before the e-mails are deleted. This is normal for most accounts since e-mail is typically accessed on a regular basis using an e-mail client such as Outlook, Outlook Express or Eudora.

WREC accepts no responsibility for viruses that may be transmitted to you via email, ftp, http or any other means of electronic transfer. WREC does provide some virus scanning on its servers. We are monitoring for viruses that could affect our Linux servers, and not viruses that could affect other operating systems like Windows. Therefore, we cannot prevent the transmission of viruses to your computer system via the Internet. It is the responsibility of the Subscriber to ensure they have Virus Software and that it is updated regularly.

Privacy Policy

WREC is committed to respecting the privacy of our members. The personal information you provide to us in order to set up your Service and e-mail account(s) is used by us solely to provide you with access to the Service and to facilitate accurate account billing. We do not sell our subscribing member lists or any member’s personal information to others for any reason. Additionally, we do not regularly monitor our subscribing members' email content or track their movements on the Internet.

We will do everything possible to protect your privacy and will not subject you outside marketing. Information about WREC Wireless Service subscribers will be released only to the subscriber, to the appropriate WREC employees, or to duly authorized officers of the state and federal courts, or investigating authorities who present the proper legal documents.

Spam

WREC is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, (i.e. any unsolicited mass, segmented, or individualized commercial email) from being sent over (from or through) the WREC network by our subscribers. We also prohibit the selling of products that can be used for spamming.

We react quickly and seriously to violations, and we further reserve the right to terminate WREC Internet access, without prior notice, of any member disregarding this policy.

If you have any complaints or comments regarding Spam on our network, please direct them via email to abuse@wrecwireless.coop.

Account Ownership

WREC is only responsible to the present owner of the e-mail and/or Personal Web Space allocated to the account on WREC servers. We verify ownership by asking for the account owner’s full name, address, email address, username, & password. If you give this information to any other party or give access to your email address or personal website on your account to another party, you risk having your Web site and any other information on your account changed and/or deleted. We are not responsible for any information on your account should you reveal this information to another party who causes damage to your account and/or Web site.

Content Policy

All services provided by WREC may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless WREC from any claims resulting from the use of the service that damages the subscriber or any other party.

Pornography and sex-related links or merchandising is prohibited on all WREC networks. This includes sites that may infer sexual content, or links to adult content elsewhere. WREC will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote illegal activity or present content that may be damaging to WREC servers or any other server on the Internet. Links to such materials are also prohibited. Examples of unacceptable content or links:

  • Pirated software
  • Hacker programs or archives
  • Warez sites
  • Pornography or Adult Material

Any deliberate attempt to cause damage to WREC or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.

WREC will be the sole arbiter as to what constitutes a violation of this provision.

Chat Policy:

WREC does not allow its subscribers to host chat rooms. You can however link your site to a chat provider.

Sub hosting Policy:

Sub hosting (personal web-space for someone other than the account owner) WREC is not allowed on WREC servers. Web hosting services for commercial purposes may be obtained from any reputable Web Hosting service, or by contacting the Administrator at WREC headquarters in Wells. (775) 752-3328.

Traffic Policy:

WREC imposes very generous traffic limits that most sites never reach, unless the sites offer shareware, sound, video, image and multimedia archives, are mirror sites, or any site whose primary purpose is file distribution. WREC members are discouraged from storing any files that cause excessive traffic on WREC servers. Please contact the WREC Technical Support team for more information. Again, most of the sites do not fall into this category and never reach our traffic limits.

We reserve the right to charge additional fees for sites that exceed our generous traffic limits. Sites that exceed their traffic limits will be suspended without prior notification if they do not purchase add-on traffic packages.

Backups:

Full backups are made weekly, and backups of new/changed data made nightly. No guarantees are made of any kind, either express or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the subscriber’s responsibility to maintain local copies of their e-mail and Personal Web Space content and any information on their account including but not limited to subscriber’s website, email, databases, mailing lists, and archives. The "Archive Manager" is included in each Personal Web Space hosting plan and Subscriber can use this tool to back up their files. If loss of data occurs due to an error of WREC, we will attempt to recover the data at no charge to the subscriber. If data loss occurs due to negligence of subscriber in securing their account or by an action of the subscriber, WREC will attempt to recover the data from the most recent archive for a flat $75.00 fee.

Indemnification Policy:

Subscriber agrees that it shall defend, indemnify, save and hold WREC harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney fees, asserted against WREC for any service provided or performed or agreed to be performed or any products sold by customer, agents, employees or its assigns. By way of example and not limitation, Subscriber agrees to defend, indemnify and hold WREC harmless against liabilities arising out of:

  1. Any injury to person or property caused by any products sold or otherwise distributed in connection with WREC’s server;
  2. Any material supplied by Subscriber infringing or allegedly infringing on the proprietary rights of a third party;
  3. Copyright infringement; and,
  4. Any defective products sold to Subscriber from WREC’s server.
